Orlando Asylum Attorney
The U.S. Court of Appeals for the Ninth Circuit in San Francisco, California, handed down a decision on March 7, 2019, that will potentially have an effect on many other immigration cases currently in process across the U.S. The court ruled that immigrants who request asylum and are denied and fast-tracked for deportation have the right to appeal their cases. This could have a significant impact on the ability of Immigration and Customs Enforcement (ICE) and other government agencies to rush immigrants through the deportation process.
The Specifics of the Case
The American Civil Liberties Union (ACLU) filed a lawsuit on behalf of Vijayakumar Thuraissigiam, a Sri Lankan man who fled his home country in 2016 after being jailed and tortured by intelligence officers during the course of the Sri Lankan civil war. He entered the U.S. on February 17, 2017, and was promptly arrested by a U.S. Border Patrol agent approximately 25 yards from the U.S.-Mexico border. Thuraissigiam requested asylum, which was denied after only a cursory review of the evidence and a brief hearing. The ACLU took action on Thuraissigiam’s behalf to protect his right to due process in his application for asylum in the U.S.
Implications for Future Cases
This decision could put a stop to the practice of “fast-tracking” deportation proceedings for immigrants who may lack the verbal skills or knowledge to represent themselves effectively in these initial hearings. By providing immigrants with the right to appeal these decisions, the court’s ruling will offer an added level of protection against deportation for these vulnerable individuals.
