Federal Judge Rejects Trump Attempt to Overturn Immigration Order

A federal judge in the state of California rejected an argument by the Trump administration regarding the detention of children and parents at the U.S. border. On July 9, 2018, U.S. District Judge Dolly Gee indicated that the government had not provided new evidence supporting its efforts to overturn the Flores agreement established in 1997 that provided guidelines for detaining children and their parents in immigration cases.

A Cynical Attempt to Shift Responsibility

Gee had harsh words for the Trump administration, accusing officials of trying to shift the blame for failed immigration policies and the practice of separating children from their parents at the border from the executive branch to the judicial branch of the government. President Donald Trump and his administration were seeking an alteration to the current law that would allow them to detain families together for longer periods of time. Current legal precedents generally restrict the detention times for children to 20 days or less.

Trump Officials Cite “Crisis”

According to U.S. Department of Justice spokesman Devin O’Malley, the attempt to revise or revoke the Flores agreement was prompted by the “current crisis of families making the dangerous and unlawful journey” across the U.S.-Mexico border. Gee rejected this argument as a “false narrative” and rejected the argument that the Flores court order was responsible for separating families at the border.
