Judge Overturns Trump’s Decision to End DACA

DACA Reinstation

Recent Ruling for DACA Reinstation

The recent ruling by Judge John Bates that reinstated Deferred Action for Childhood Arrivals (DACA) protections has received general acclaim from immigration and human rights activists across the country. Bates issued a ruling on April 24, 2018, that the Trump administration must either present a more persuasive justification for this change or allow the existing program to continue as intended. He rejected the arguments previously made by Attorney-General Jeff Sessions that the original DACA program was unconstitutional and illegal and that the federal government feared litigation from states unhappy with the provisions of the program.

Arbitrary and Capricious

The reinstatement of DACA protections has offered renewed hope for those currently in the country and pursuing permanent residency under the program’s provisions. Many DACA participants have no memory of the country from which they immigrated and no known relatives in that area. By threatening these individuals with detention and deportation, the Trump administration has effectively terrorized many young people who are seeking educational and employment opportunities in the only country they have ever known as home.

An Opportunity to Justify

The Bates ruling does leave room for the Trump administration to provide more compelling and persuasive arguments to show why DACA should be discontinued. The judge left open the possibility that DACA could still be repealed if immigration officials could present real and credible justifications for the cessation of the program. This has left many immigration activists concerned about the fate of DACA recipients and the possibility that they might still face arrest and deportation at some point in the future.
