The Trump administration has announced changes to the H-1B visa lottery, which would benefit applicants with more advanced educational degrees. The rule change, follows President Donald Trump’s 2017 “Buy American and Hire American” executive order, which prompts the Department of Homeland Security to make sure that H-1B visas are granted to the most-skilled, or to those with the highest educational degrees. The new rule is effective on April 1, 2019, with USCIS (United States Citizenship and Immigration Services) accepting petitions beginning on that date. The 2020 season to accept H-1B visa petitions will extend from October 1, 2019 to September 30, 2020.
Before the new rule went into effect, applicants with a master’s degree or higher from a U.S. college or university would have the initial opportunity to apply for one of the 20,000 advanced-degree H-1B visas. Those who weren’t selected during that round would have been added to the general applicant pool for a chance to obtain one of the 65,000 slots each year.
The process has been reversed after the new rule was introduced so that after the 65,000 slots are filled, any advanced degree holders who didn’t get selected would compete for the remaining 20,000 visas. There are only 85,000 H-1B visas awarded per year. The change is to encourage a higher number of H-1B recipients with a master’s or higher degree achieved from U.S. schools to participate in the lottery. These rule changes would help bring the best and brightest workers from around the world to America under the H-1B program.
